Recently there have been comments on the hotlist about exit criteria and required services. Our bureau would like to clarify some points that were made.
For students in grades K through 12, an ACCESS for ELLs proficiency level of 4.5 or higher is recommended for exiting a program if multiple criteria support the decision. Exit scores vary on other approved proficiency tests. Multiple criteria for exit are listed below.
From N.J.A.C. 6A:15-1.10 (c)
The process to determine the readiness or inability of the individual student to function successfully in the English only program shall be initiated by the student's level of English proficiency as measured by a Department established standard on an English language proficiency test, and the readiness of the student shall be further assessed on the basis of multiple indicators which shall, at a minimum, include classroom performance, the student's reading level in English, the judgment of the teaching staff member or members responsible for the educational program of the student, and performance on achievement tests in English according to P.L. 1991, c. 12.

Below are the program time requirements for "ELS", "ESL", and "High Intensity ESL".
- ELS: for districts with less than 10 ELLs (example of ESL services: 90-100 minutes-per-week for each student)
- ESL: at least 1 period-per-day for districts with less than 20 ELLs in one language group
- High Intensity ESL: at least 2 periods-per-day for districts who request this program type in their bilingual waiver
